1 Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website located at EasyResumesAI.com, our mobile applications, and all related services, features, content, and products offered by Easy Resumes AI (collectively, the "Service").

If you are using the Service on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.

If you do not agree to these Terms, you must not access or use the Service.

2 Description of Service

Easy Resumes AI provides an AI-powered resume analysis and optimization platform. Our Service includes, without limitation:

• Applicant Tracking System (ATS) scoring and compatibility analysis for uploaded resumes
• AI-generated suggestions to improve resume content, formatting, and keyword alignment
• Job description parsing and resume-to-job matching analysis
• Customized resume building and rewriting tools
• Dashboard to manage and track multiple resume versions

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3 Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that:

• You are at least 16 years of age;
• You have the legal capacity to enter into a binding agreement;
• Your use of the Service does not violate any applicable laws or regulations in your jurisdiction; and
• You have not been previously suspended or removed from the Service.

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

4 Accounts & Registration

Certain features of the Service require you to create an account. When you register, you agree to:

• Provide accurate, current, and complete information during registration;
• Maintain and promptly update your account information to keep it accurate;
• Maintain the security and confidentiality of your password;
• Accept responsibility for all activities that occur under your account; and
• Notify us immediately at support@easyresumesai.com if you suspect unauthorized access to your account.

You may not share your account credentials with any third party. Easy Resumes AI reserves the right to terminate accounts that violate these Terms, or to reclaim usernames that we determine are inappropriate.

You are solely responsible for any activity on your account and for maintaining the confidentiality of your login credentials. Easy Resumes AI will not be liable for any loss or damage arising from unauthorized use of your account.

5 License to Use the Service

Subject to your compliance with these Terms and payment of any applicable fees, Easy Resumes AI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial purposes.

This license does not include the right to:

• Reproduce, distribute, publicly display, or create derivative works of the Service or its content;
• Sell, resell, or commercially exploit any part of the Service;
• Reverse engineer, decompile, or otherwise attempt to extract the source code of any part of the Service;
• Use the Service to build a competing product or service;
• Scrape, crawl, or use automated means to access the Service without our express written permission.

All rights not expressly granted to you in these Terms are reserved by Easy Resumes AI.

6 Your Content

6.1 Ownership

You retain full ownership of all resumes, job descriptions, and other content you upload or input into the Service ("Your Content"). Easy Resumes AI does not claim ownership of Your Content.

6.2 License to Easy Resumes AI

By submitting Your Content to the Service, you grant Easy Resumes AI a limited, worldwide, royalty-free, non-exclusive license to process, store, and analyze Your Content solely for the purpose of providing and improving the Service to you. This license is limited in scope and does not permit us to sell, share, or otherwise commercially exploit Your Content.

6.3 Your Representations

You represent and warrant that:

• You own or have the necessary rights to submit Your Content;
• Your Content does not infringe any third-party intellectual property rights, privacy rights, or other legal rights;
• Your Content is accurate and does not contain false or misleading information about yourself or others; and
• Your Content does not violate any applicable law or these Terms.

6.4 Content Removal

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is otherwise objectionable. We are not obligated to monitor Your Content but may do so for compliance and safety purposes.

7 Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable local, state, national, or international law or regulation;
• Uploading or transmitting content that is unlawful, defamatory, obscene, harassing, threatening, or fraudulent;
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity;
• Attempting to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service;
• Using the Service to send unsolicited communications (spam);
• Introducing viruses, malware, or other malicious code into the Service;
• Using automated scripts, bots, scrapers, or other tools to access or interact with the Service without our written permission;
• Interfering with or disrupting the integrity or performance of the Service or servers connected to it;
• Using the Service for any illegal or unauthorized purpose, including submitting falsified or fabricated resume information with intent to defraud employers;
• Attempting to circumvent any content filtering or security measures we employ.

Violation of these prohibitions may result in immediate termination of your account and may expose you to civil or criminal liability.

8 Payments, Fees & Refunds

8.1 Paid Plans

Certain features of the Service are available only upon payment of a fee. By purchasing a paid plan, you agree to pay the applicable fees as described at the time of purchase. All fees are stated in U.S. dollars unless otherwise indicated.

8.2 Payment Processing

Payments are processed by our third-party payment processor, Stripe. By providing payment information, you authorize us (through Stripe) to charge the applicable fees to your selected payment method. You agree to Stripe's terms of service, available at stripe.com/legal.

8.3 One-Time Purchases

Where we offer lifetime or one-time access plans, your payment grants you access to the features described at the time of purchase for as long as we continue to offer those features. We reserve the right to modify or discontinue features, though we will make reasonable efforts to notify you of material changes.

8.4 Subscriptions

If you purchase a subscription plan, your subscription will automatically renew at the end of each billing period at the then-current rate unless you cancel before the renewal date. You may cancel at any time from your account settings.

8.5 Refund Policy

We offer refunds in accordance with our Refund Policy. If you believe you are entitled to a refund, please contact us at support@easyresumesai.com within the applicable refund window. We reserve the right to deny refund requests that we determine to be fraudulent or abusive.

8.6 Taxes

You are responsible for all applicable taxes arising from your purchase. Where required by law, Easy Resumes AI may collect and remit applicable sales tax.

9 Intellectual Property

The Service and all content, features, and functionality — including but not limited to software, code, text, graphics, logos, icons, images, audio clips, and the look and feel of the Service — are owned by Easy Resumes AI or its licensors and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.

The Easy Resumes AI name, logo, and all related product names are trademarks or registered trademarks of Easy Resumes AI. You may not use our trademarks without our prior written consent.

Any feedback, suggestions, or ideas you provide regarding the Service ("Feedback") are entirely voluntary. You hereby grant Easy Resumes AI a perpetual, irrevocable, royalty-free license to use, reproduce, modify, and incorporate such Feedback into the Service without any obligation to you.

10 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EASY RESUMES AI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR RESULTS PROVIDED THROUGH THE SERVICE.

Easy Resumes AI does not guarantee that use of the Service will result in job interviews, job offers, or any other employment outcome. ATS scores and resume suggestions are provided for informational purposes only and do not constitute professional career or legal advice.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.

11 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EASY RESUMES AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
• LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES;
• DAMAGES RESULTING FROM YOUR ACCESS TO OR INABILITY TO ACCESS THE SERVICE;
• DAMAGES RESULTING FROM ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT;
• DAMAGES RESULTING FROM ANY THIRD-PARTY CONDUCT ON THE SERVICE.

IN NO EVENT SHALL EASY RESUMES AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO EASY RESUMES AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the limitation of liability for certain types of damages, so the above limitations may not apply to you in full.

12 Indemnification

You agree to defend, indemnify, and hold harmless Easy Resumes AI and its officers, directors, employees, agents, contractors, and licensors from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or in any way related to:

• Your access to or use of the Service;
• Your Content;
• Your violation of these Terms;
• Your violation of any rights of a third party, including intellectual property, privacy, or publicity rights; or
• Your violation of any applicable law or regulation.

Easy Resumes AI reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense of such claim.

13 Termination

13.1 Termination by You

You may stop using the Service at any time. If you have a registered account, you may delete it from your account settings. Upon deletion, your access to paid features will cease at the end of any current billing period.

13.2 Termination by Easy Resumes AI

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, Easy Resumes AI, third parties, or the integrity of the Service.

13.3 Effect of Termination

Upon termination of your account:

• Your license to use the Service will immediately terminate;
• We may delete Your Content in accordance with our Privacy Policy and data retention schedules;
• Provisions of these Terms that by their nature should survive termination will remain in effect, including Sections 9, 10, 11, 12, 14, and 15.

14 Dispute Resolution

14.1 Informal Resolution

Before filing any formal legal claim, you agree to first contact us at legal@easyresumesai.com and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice. If the dispute is not resolved within that period, either party may pursue formal resolution.

14.2 Binding Arbitration

Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English. The arbitrator's decision will be final and binding, subject to limited judicial review as permitted by law.

14.3 Class Action Waiver

YOU AND EASY RESUMES AI EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. All disputes must be brought on an individual basis only.

14.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property or confidentiality rights.

15 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law provisions.

To the extent that any claim or dispute is not subject to arbitration under Section 14, you consent to the exclusive personal jurisdiction of the state and federal courts located in New York County, New York, for the resolution of such disputes.

16 Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page;
• Send a notification to your registered email address at least 14 days before changes take effect; and
• Display a prominent notice on the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

For minor changes (such as corrections of typographical errors or clarifications that do not materially affect your rights), we may update the Terms without prior notice.
